Description
Hermance Law is seeking an experienced Litigation Attorney (CONTRACTOR) with a strong background in California probate and trust administration litigation to join our team on an "as need be" basis.
This role is ideal for a highly skilled litigator who values flexibility, can work independently, and has proven experience handling contested probate and trust matters from start to finish-including mediation and trial work.
You must be licensed to practice law in California and have direct experience in probate and trust litigation. A California State Bar Certified Specialist in Estate Planning, Trust & Probate Law is strongly preferred.
This is a virtual position, with hours ranging from 0-10 per week initially, and the potential for more as our contested caseload grows.
Responsibilities
• Manage contested probate and trust administration cases from intake to resolution
• Develop litigation strategy and oversee all case phases, including discovery, mediation, and trial
• Draft and review pleadings, motions, discovery, and settlement agreements
• Conduct depositions, attend hearings, mediations, and trials (primarily virtual; some in-person appearances possible)
• Advise clients and provide clear, compassionate guidance throughout the litigation process
• Work collaboratively with paralegals and support staff to ensure efficient case progression
• Ensure compliance with all court rules, deadlines, and procedural requirements
Qualifications
• Active license to practice law in California
• Minimum 5 years of probate and trust litigation experience in California
• Mediation and trial experience required
• Strong knowledge of California Probate Code, litigation procedures, and local court rules
• Certified Specialist in Estate Planning, Trust & Probate Law (preferred)
• Excellent legal writing, oral advocacy, and negotiation skills
• Ability to work independently, manage deadlines, and take ownership of cases
• Proficient with Clio or similar case management software
